ATTORNEY GRIEVANCE COMM'N v. STANALONIS

Issue: What sanction should the Court impose upon an attorney whose campaign flyer for judicial office stated that a newly-appointed incumbent judge opposed the registration of sexual predators?

Holding: As the hearing judge found that the rival candidate had a “demonstrable basis” for believing the statement to be true, the Court did not find clear and convincing evidence that the campaign flyer violated the Maryland Lawyers’ Rules of Professional Conduct, and dismissed the case.

Alleged Violations: Maryland Lawyers' Rules of Professional Conduct ("MLRPC") 8.2(a) (false statement as to qualification or integrity of a judge, public legal officer, or candidate for such office), MLRPC 8.4(c) (misconduct involving dishonesty, fraud, deceit, or misrepresentation), and MLRPC 8.4(d) (misconduct prejudicial to the administration of justice).
